CVS answers firefighters’ boycott over Cushman

Union president threatens statewide, national action

CVS Health has found no wrongdoing on the part of one of its employees, former Ward 1 councilman and former chairman of the Warwick School Committee Robert Cushman, in response to demands by the president of the Warwick Firefighters Union.

The union’s president, William Lloyd, threatened a statewide – followed by a national – boycott of the pharmacy chain because of Cushman, a full-time business analyst with the company.

Cushman has been critical of the firefighter and police pension liabilities faced by the city. Firefighters have questioned Cushman’s credentials.

In an email Tuesday, CVS spokesman Michael DeAngelis released the following statement: “After investigating this matter, we determined that Mr. Cushman did not claim to be representing CVS Health or speaking on behalf of the Company when he exercised his rights as a private citizen at a public meeting in his hometown.”

The email continues: “As such, we have no position on his comments. We believe the IAFF Local 2748’s call for a boycott of CVS/pharmacy is misplaced and not warranted. We have a strong track record of supporting emergency responders, and we appreciate all they do to protect our communities.”

Cushman said CVS executives brought Lloyd’s email to his attention more than a month ago. He said the company questioned him, and reviewed tapes of a presentation he made to the City Council in December. Cushman said he was later shown a copy of the CVS reply, which according to DeAngelis closely followed the statement released to the Beacon.

DeAngelis did not feel it proper to release Lloyd’s email to the paper. Cushman did not have a copy.

In an interview yesterday, Lloyd said the letter that was addressed to DeAngelis never called for Cushman’s dismissal, but that because Cushman is an employee “we would not be using CVS anymore.”

“I never made a threat against his job,” Lloyd said. “I never said anything about getting Bob Cushman fired.”

Lloyd said a boycott was not a singular decision, and that the union unanimously voted for it.

“A vote taken by all members, it wasn’t me just spouting off,” he said.

Lloyd said he emailed the letter from his home computer and on his time, and that it was sent last year after Cushman made an appeal to address the council. He said in that request, Cushman said he worked as an analyst for CVS.

The email comes after a highly publicized and charged December City Council meeting during which Cushman outlined his premise that the legacy costs of pensions and health care for retirees are cutting into what the city could spend on capital projects, including roads and buildings.

Even before Cushman’s presentation, his request to appear before the council was controversial, with some members saying they could learn from his expertise while others claimed it would be a waste of time.

Cushman illustrated how employee benefits have climbed to 42 percent of the municipal budget, and called for development of a strategic plan for a sustainable future.

Throughout his presentation, there were whistles from an audience comprised largely of firefighters and municipal employees. During his presentation, Lloyd stood only feet behind Cushman with his arms folded across this chest. Lloyd’s conduct was not questioned by City Council President Donna Travis, or by police who were on duty for the meeting.

Lloyd’s email was the subject of a posting appearing on Warwick WATCH, a Facebook page, on April 15. The posting did not name Cushman, but claims Lloyd said firefighters would boycott CVS unless its employee is dismissed. In another post yesterday, Cushman is named. The post goes on to question why the news media has not followed up on the story.

A copy of the first posting that questioned what the mayor knew of the latter, and what he was doing about it, was provided to Mayor Scott Avedisian last Thursday. In an email to the paper, Avedisian said he and Chief Edmund Armstrong knew nothing of Lloyd’s email.

On Monday, after DeAngelis told the Beacon CVS would have a statement regarding the incident, Avedisian issued the following statement: “My administration has not been able to get an actual copy of the communication that went from Mr. Lloyd to CVS. And while neither I nor Chiefs Armstrong, Cooley, or McLaughlin sanctioned or condoned the letter, I must reiterate that the firefighters union has every right to conduct their business even if the city or the chiefs would not take that course of action.”

In a letter Monday to the mayor that he released to the media, Rob Cote, who videoed firefighters on duty attending a marina barbecue last summer, called for an investigation.

“Mayor, it is time that you take a stand against certain behavior of employees in this city. In the absence of such, further harassment of residents can only be certain and hard working employees suffer a bad branding over the actions of a few,” he writes.

    As of 5:18 pm this article had 966 views. So we know that every firefighter has read it. Why no comments? Why was it that not one firefighter called the Dan Yorke show today? Why hasn't Lloyd made his e-mail public if he and all of the union members supported it and if it was a unanimous decision? Where is the chief and the mayor? Where is SteveD, Scal1024, Unionthug and the rest of the faceless people who condemn everyone who posts a comment on this site, yet are afraid to get up to the microphone at city hall, show their face, and make a statement? Yet they brag constantly that they are all hero's of outstanding moral fibre?

    Lloyds words, "the action was unanimous". That means that all of the firefighters approve and voted to threaten a resident at his job, and attempt to sequester a residents 1st Amendment rights. Says a lot about individual integrity doesn't it? The silence is deafening. It would appear that all of the thugs have been instructed to keep their mouths shut and not to comment. Priceless. The leader of the pack is called out statewide on radio as a complete moron, and he is the one you guys elected to speak for the rank and file? You really don't have anyone smarter than him? How sad. Speaks volumes for the intelligence factor.

    You guys should all be ashamed of him, and of yourselves for not condemning his behavior. But then again, after what I witnessed with the rank and file's actions on the night of Mr. Cushman's presentation, we shouldn't be surprised of this behavior.

    Mr. Yorke made a couple of real good points today pertaining to the thuggery.

    Mr. Firefighter, when you are putting your children to bed tonight and they tell you that they want to grow up to be a hero just like you, do you tell them that you heckled, cursed, whistled and acted like a moron to attempt to derail a persons right of free speech? Do you tell your kids that you all get together in a group at a council meeting and try to intimidate residents? Are you guys proud of Mr. Lloyd's actions? Every call into WPRO condemned your actions and yet, not one firefighter had the courage to call in and denounce Lloyds actions.

    Every resident appreciates and acknowledges your role in the community, we are just tired of having it constantly jammed in our faces that you are all priceless and irreplaceable. This is an example of someone who should be replaced immediately.

    I'm not sure what it is that makes you think I'm hiding but that's silly. First of all Mr. Lloyd is 100% wrong. I do not agree with what he did, I find these tactics unacceptable and against what our country is about. Second of all, I do not work for any department in this city. I have never been one of those people who have questioned Cushman's numbers...and you can read any comment I've posted on the topic.

    The part I have disagreed with is the recording of city employees. I still stand by that point. Boycotting a business based on political views is a very scary and dangerous precedent to set, and I wish more leaders would speak out against this...but they won't.

    Don't be so quick to judge captain, we're not always in disagreement.

    What a sad day for the WFD. Comrade Putin would be proud of Mr. Lloyd. How much hubris must the firefighters have to think they could destroy Mr. Cushman's right of free speech and the citizens would sit still and let this happen.

    Mr. Cushman as a private citizen has the right to say anything he wants under our Constitution. What don't the firefighters like about that ?

    It is amazing that the council president and other members of the council even let this nonsense happen.

    Yet not at all surprising given that Donna Travis has tried to pass resolutions banning free speech.

    The thug union president creeping up and essentially threatening someone trying to help his community should have been given a state police escort out of the building.

    Firefighters lost all respect with this move.

    At some point they need to realize there is no money to pay for the unrealistic benefits that were promised to them and they're better off taking adjustments to bring things more in alignment with reality than being screwed in the end when they're near or in retirement.

    All your union leadership cares about is dues, if they really cared about your best interests they'd negotiate realistic contracts within the resources of the business you're working for. Taxpayers are not an infinite cash cow.

    Mr, Cushman does have his freedom of speech but so do the fireman and every other citizen in the United States.They have the right to speak out against Mr. Cushman. The firemen have the right to boycott C.V.S. and go to Walgreens if they choose because c.v.s. employs Mr. Cushman. People across America are boycotting sponsors of Rush Limbaugh because of his hate speech and it is working. Rush has lost many sponsors and has been taken off many Radio stations because of his hate speech. I believe Mr.Cushman hates public empoyees and does not value them or what they do.

    Anyone is entitled to boycott what they want. My point is if everyone is going to boycott based on political affiliations than our country/state/city is in big trouble.

    The firemen who work for WFD do an excellent job and deserve to be thanked as often as possible. I just disagree with how they went about this particular issue (assuming they all knew, which I don't think has been proven yet).

    Technically this may be a secondary boycott since the union has no direct connection to the retail chain. Under that antitrust provision If the firefighters did in fact vote on this boycott, the mayor should step in with a request to withdraw. The union leadership should seek legal advise.

    I'm not a fan of Cushman's views nor of CVS, not since they bribed a state rep years ago. However, going after a guy's livelihood because of his political affilitation or stance on an issue is about as un-American as can be. Firefighters are normally thougt of as American as apple pie. Some bad apples in this pie. Bad form all around. The WFD is making itself look like a bunch of thugs.

    "Notbornyesterday" I am asking this question as someone who doesn't know the answer. If the purpose of the letter wasn't to call for his job, than what was the reasoning behind it? That's the part I don't understand about all of this. What did Cushman do that called for the letter being written in the first place? Do you guys dispute the numbers? Is it something he's said about the WFD? If you know it didn't call for his job, then I'm at least hoping you know what the intent was.

    We will never know with certainty but maybe that was there angle to show a worker abusing his working privileges while on company time and not doing his task at hand but gathering all this information while being paid by CVS.

    Scal, I believe (I never saw a copy of the letter or its content) the intent was to inform CVS that an employee who we have our disagreements with used his CVS background multiple times in his presentation. I don't disagree with all of his numbers, I disagree with assumptions. I disagree with one bad plan ruining the city when the other three are in much better shape. We as firefighters always sit and do our job we never get involved with finger pointing and name calling. Up until a couple years ago when people are hiding out in the bushes and cars filming us (for no reason). Stacia blatantly making false accusations about shopping, staffing, etc... I'm tired of being a punching bag about my salary and how RICH I am. I'm not rich, trust me. Stacia will say if your not doing anything wrong then who cares if your getting filmed. I DO... I come to work everyday, I do my job extremely well and your going to try and catch me screwing up? Come on. Im tired of it. Our morale is at an extreme low because of these attacks. WE KNOW THERE IS A PROBLEM WITH PENSIONS AND HEALTHCARE. We have been working to help fix them. So scal the letter (right or wrong) was an attempt to stop the beating that we all take day in and out. Trust me we want to do our jobs and be silent. I can't be silent when people are after my livelihood. I pay taxes too, I don't want them any higher. But this group from warwick watch keeps picking and picking at us. There is a nice way of working with us and there is the nasty way. THEY CHOSEN THE NASTY WAY FIRST.

    Why would there be a threatened boycott if it wasn't to get Mr. Cushman fired? Clearly if Mr. Lloyd's intent has been wrongly characterized he should release the email and let light shine down on the truth. The taxpayers deserve to know the actual costs of city services. City workers deserve to know that their promised compensation is going to be delivered. Right now neither side is getting what it wants. You don't have to look far to know that what I'm saying is accurate. Providence has needed massive concessions. Central Falls went bankrupt and one of the Coventry fire districts went bankrupt. Raising taxes every year while squeezing city services is not a sustainable model. Nearly all new tax revenue raised goes to pensions and retiree benefits. The administration must address this.

    A little cheese with that whine? I dont agree with the stacia thing at all actually, but when you work for the PUBLIC, and are paid by TAXPAYERS, it is appropriate to expect scrutiny form them. To turn around as government employees and go to a private company and try to harm the employee's position because of his particular position on civics is just wrong. Criticize Cushman in the papers and at meetings, but the second you contacted his private employer you just went over the line. Period.

What strikes me as amazing is the number of stories I have read since then arguing over local and state public pensions, and the venom these debates tend to generate. Something foul is going on when they remain a major and persistent news story in a state struggling to stay afloat economically.

    The fireman and all the other unions in the city have known for years their pensions and healthcare benefits were unsustainable. They just chose to ignore it. Mr. Cushman dares to point out the obvious and he is vilified by Mr. Lloyd and the fire union. Let's not forget Mr. Lloyd is quoted as saying the union voted in favor of sending the email to CVS. What did Mr. Lloyd and his union think.....CVS would give Mr. Cushman a raise ? Really ?????

    If the unions have a beef it should be directed at Avedisian and Lloyd for promising them the world knowing full well it can't e delivered.

    What about all the overtime the fire dept racks up every year. Don't they think the taxpayers are noticing ? Especially ones with children in school.....the schools are leveled funded but Armstrong and company just waste our money.

    At the end of the day Lloyd and his fire union violated the basic tenet of our constitution......one Roger Williams found this state on......Mr. Cushman's right of free speech and the citizens of Warwick will hold them accountable forever on this. Shame on you Mr. Lloyd.

    If you go to YouTube and search you'll find Mr. Cushman's presentation on December 15th, 2014, to the City Council. At no point was there any mention of CVS. Mr. Lloyd, by involving CVS, has possibly infringed upon Mr. Cushman's 1st Amendment rights.

    What I was trying to say is that Cushman, Cote and who ever are always complaining about city employees wasting time and screwing off on city time. With that being said if Mr. Cushman did it while at work at CVS and not from home isn't that the same thing?

    Please don't say he isn't a public employee but works for private business it's the same thing essentially.

    Also I find ironic is we all know every one Of us myself included has given a perfect work day in all of our jobs what ever they may be so if you try and say otherwise it's pretty foolish of you. We all get side tracked occasionally.

    Maybe we should abolish the NCAA brackets or the Super Bowl squares that take over in January and March around the water coolers in offices and on all 3 national news broadcasts. We should be robots that can do no wrong to give the cities, states and owners of private companies the best bang for there buck!

    It's not possible we all yourself included have off days it's human nature.

    It's a black eye for the FD obviously we all agree I don't know the players but if I'm an employee I would be pretty upset to be included in this fiasco.

    I'm a little confused...Didn't this all start when Mr. Cushman attempted to raise the issue regarding the size and scope of the problems with the city pension system and the unfunded liability? Is that what got some union members, including firemen, causing them to have a bee in their bonnet? Is it true that after Cushman was granted permission to make a presentation before the council, that during the presentation a union member stood next to Mr. Cushman all during that analysis? I am told Mr. Cushman is not a large fellow, so were they protecting him or attempting to intimidate him? Now we have the whole CVS issue...Including whether or not Cushman did work on company time? A private company, (publicly traded) with its own set of rules, regulations, policies and corporate governance. In short, if he was caught doing that he would be disciplined or fired.

    Well Mr. Lloyd, it seems YOU opened the pandora's box..Suppose we hold the same standard to city employees? "Borrowing" city equipment to do private work on the side? How about current or retired city workers doing work as contractors, plumbers, electricians, roofers, painters etc...? I'm sure they all have in force contractors licenses with the contractors licinsing board along with proper workers comp. insurance, liability insurance, after all, they may be competing against IBEW workers and other tradesmen on certain jobs? What about looking at potential jobs using city vehicles on city time? Taxpayers in this city and State have a right to be suspicious and flat out angry because we've all seen this before in RI. Just do your job.

    Dear Notbornyesterday,

    Obviously by your past postings you are a Warwick Firefighter. Thank you for your service and dedication. However, in Mr. Lloyds own words he states that" his letter was a unanimous decision that all of the WFD members voted on". So if in fact he is telling the truth, logic would assume that you all saw the contents of the letter. So why are you asking Mr. Cushman to release the e-mail when clearly you should be asking Mr. Lloyd to release the email since in fact it was generated by him. Now, if in fact Mr. Lloyd is not being truthful and there was not a unanimous vote, then there is clearly a credibility issue with his statement which would still put the burden of proof back on him, which by all accounts, all the WFD members should compel him to release the email that he generated.

    Please walk us through the procedure that took place when the "alleged" voting took place. How were you notified that there was going to be a vote, where was the meeting held, how many members showed up and voted, and what constitutes unanimous and what date did the vote take place? To gain any sense of credibility the names of all members that voted should be released. Did Mr. Lloyd review the contents of the email that he was going to send, or did all of you just vote blindly with no knowledge of the content of the email?

    There is the appearance that you guys cant keep your stories straight, nor can you present the facts to do such. Why has there not been any comment from the administration as of this date?

    I think that we all need to stick to the point and focus on the main issue at hand. The issue is that Mr. Lloyd needs to come public and release his email when he returns home from his vacation. In the absence of him doing so, the reputation of the FFs and the integrity of all has now become in serious question. In the absence of doing so and showing a good faith non thug position, this group (union) fall into the classification as thugs that will go to any and all means, including civil rights violations to sequester anyone who they feel are in any type of opposition to their points.     I still have several questions about this letter. How has Mr. Cushman not asked for a copy? After learning that its possible that a minority of WFD were at the meeting, does this really call into question the departments integrity? The department does a lot of good in this community. The problem is this issue is passionate. Members of the WFD have worked hard, contributed to pensions, and have been told they will get to retire with "x" amount. These contracts were negotiated in good faith, not with ill will or contempt for taxpayers.

    On the taxpayer side people are tired of property taxes and car taxes that are regressive in nature. (Keep in mind city employees are not exempt from these taxes). Year after year taxes go up, and people begin to resent the public sector. I don't understand the anger at people who go to work everyday, some risking their lives for this city. Not many people would allow their work to slash their benefits and pay without gaining something in return. We should not expect differently from our public employees.

    While I feel that concessions are needed, I believe that the administration will need to give something in return. You cannot demand employees take pay cuts, contribute more towards pensions and health care without giving a little. How do you get this done? Start with new hires? People with less than 10 years? What is REALISTIC? Let's stop with the video taping and demonization of these guys. How can this city be on stronger financial ground? Something that I know both sides are interested in.

You should research the Supreme Court ruling that has been consistently upheld that states that a public sector employee, whose salary is paid by tax dollars, has no expectation to privacy while on the job. Look it up. That means in layman's terms, that I and any other resident can document any public sector employees performance on the job, and question whether or not his actions are consistent with union labor agreements, ethical behavior, city ordinances, and a host of other variables. Thats the law. You dont like it, too bad, change it.

    Now stick to the point and stop the diversion.

Captain I asked a few questions about how to fix the problem (pensions) through negotiations. You didn't answer my question instead attacked someone else. If you truly care about the numbers and about rising legacy costs then how about you keep the conversation on that. Agree to stop following employees of this city around.     You will note that I reference the word thug towards a poster the goes by the name "Unionthug". Kind of speaks volumes no? You reference that "we" should repair the pension system by negotiations. Unfortunately, "we" have no seat at the table and "we", never get to see whats been negotiated. As far as filming, the first film that broke was about an individual driving dpw truck W24. He was followed daily for weeks and he never left his vehicle. He did however, leave the city, go to Covenrty, Potowomut Paek, Goddard Park, hide out in Gaspee Pt,, etc.. etc... Do you know what his job was? Testing of fire hydrants. Need I say more. There have been several issues such as this and clearly for quite sometime, the behavior showed no sign of improvement, in fact, due to no consequences, by all appearances, it increased. There have been numerous abusive behavior videos documented in Warwick and other cities by both residents and main stream media. That is fact and it needs to change. Since apparently it is being ignored by the administration, how do residents change that? The inefficencies in the city are rampant and no steps are being taken to curb them. In terms of interacting with your government, have you been to a council meeting? Once a month there is a 15 open mic where you can opine in a one way conversation while your council members text, snore and ignore, fail to make eye contact, and watch as the clock ticks down. That is no way to have dialogue. The fact is, is that any resident with any idea on how to improve productivity or make things better is ignored. If you dont think that the good conscientious workers are pissed at whats going on, you are mistaken, they are, and they too are ignored. How do you think residents and media get tips on documenting this behavior? To the point of Cushman, here is a perfect example of a resident being targeted for voicing his opinion, and doing so in front of an audience that cant hold a card to his background, education, and experience. Very sad how he was targeted as opposed to the members targeting the leadership that has lied to them for so long. Ironic to say the least. Lets stay on point and see if Lloyd holds to his word on making a radio appearance. Any wagers if he will show?

    I don't know the man...but I always assumed that "unionthug" was a play on some of the language used towards city workers on this site. Did we have a seat at statewide pension reform? No. The governor (then treasurer) tried ruling with an fist, and she learned litigation will follow. She was forced back to the table. In order to achieve actual savings with the unions they will have to be negotiated with. Any ruling without their approval will result in litigation and even more money being spent. Again I brought up substantive ideas, and was not given one single response.

    Captain you are not a journalist. For somebody objectively looking at this it seems as if your tactics go too far. People go to work everyday and resent the idea that somebody could be following them around. It is something that anyone can relate to. You always chastise people who don't go to council meetings and speak (some work and cannot follow city employees, post videos to you tube, and speak at council meetings) but have you ever considered its your tactics that people don't want to be associated with? The idea of following around someone who risks their lives everyday, just to hope you catch them screwing around sickens me. Not just me, but plenty of other hard working people in this city.

    Go investigate why Stacia Huyler uses 5 different screen names to talk to voters? Go investigate why over 3,000 people have joined a page to condemn the exact things you folks are doing. WFD isn't perfect, but I've never heard any of them claim to be. Pensions aren't perfect but they never said they were. Once again I ask, how about you take a step back and look at what you are ACTUALLY doing vs. What you THINK you're doing. You may think you are helping, I am telling you Rob you are not. Commit to putting the camera down, having real debates/solutions and actually solving problems. Not becoming a you tube hero for a dozen people. I have said this a lot on here...you, stacia, Dempsey you are all your own worst enemies. I just hope you all wake up and realize it someday.

I will say it once again as I have many times before. The Supreme Court has consistently upheld the premise that municipal employees have no expectation of privacy while and during employment hours. Period. If they hadn't given so many reasons to document their behavior, there would not have been cause to catch them in the act. Like it or not, there is an element of slackers that we pay for. It has been on going for years at our expense and it has a direct impact on the budget and on the tax base. If your ok with that, thats fine. Don't be upset that others are not ok with turning a blind eye. So lets hear your solutions.

    Moving the retirement age up for new hires in the city is a good start. It would start the ball rolling in the right direction and it's a compromise. The vested workers in this city would continue at the rate they've negotiated, but we start curbing the costs by extending work years for new employees. Providence capped pensions at 150% of the median household income. Does it have to be 150%? No, but its a number to go off of. Anything increasing co-pays should be done over time. I don't know the exact % employees pay now but slight increases over the next 2, 4, 6 years is less of a burden on the worker if it's spread out. Finally you will not get changes without giving something up...an increase in hourly pay would be good incentive to get something done. Those are a few ideas Rob....again other than hiding with a camera, what's yours???

The mayor never proposed capping pensions at 150% of median household income, when he recommended changes for new hires the public was much less aware of the pension funds status. What's your plan? Rather than admit you don't know, you continue spewing uneducated nonsense.

    You complain about WFD overtime costs, you complain about sick time being paid back. So on one hand you don't want anyone collecting overtime, and on the other hand you give them no incentive to be healthy at work. How can you square those opinions? As usual you talk out of both sides of your mouth. No consequences for the garbage you throw out there, you just say it and hope it sticks.

    You want to make Warwick better? Why is it you focus your time on who is writing these comments? You are more interested in trying to reveal someones identity than you are about fixing problems. This is not the behavior of someone who wants to run this city. This is the behavior of somebody who is a bored, bitter women with literally NOTHING better to do. You obsess over Jon Marr because he's accomplished more in a week than you have your whole career. Every personal attack you launch is seen by thousands Stacia. You've been exposed for the empty rhetoric, empty suit, empty ideas that have been a centerpiece of your campaign. You won't debate issues because you can't. Where is your plan? What are your ideas? You are NOTHING if you can't block somebody on social media, try discussing issues, than maybe someday somebody will actually take you seriously. Until them keep your dumb, nasty, negative opinions to yourself.

    @staciaisclueless You really are a tiny little worm of a boy. One day when you move out of your moms basement I hope you find the help you need. Butler hospital has great services for mentally unstable people like you, I'm sure you're familiar with them. Your mom must be real proud of the way you speak about women I hope she asks your counselor to adjust your meds before you hurt yourself.
