SHOPLIFTING

Officer Eric Lima was dispatched to the area in front of the Paper Store, 400 Bald Hill Road, at approximately 4:57 p.m. on April 15 for a report that mall security was out with an adult female suspect for shoplifting. Lima met with members of Warwick Mall security, who advised the shoplifting had not occurred at the Paper Store, but at American Eagle Outfitters, Old Navy and Aeropostale. They further advised that they were in the process of having the managers for those stores respond to the location to provide further information and indicate whether or not they wanted to file a complaint. Lima said all of the involved stores, with the exception of American Eagle, did not wish to file a complaint. Lima said he met with the assistant manager of American Eagle, who told him the suspect had been acting suspicious in the back room and she observed the woman leaving the store with un-purchased items in large shopping bags. When she followed the woman and asked her to return to the store, the manager said the woman did not comply until “an undercover officer assisted.” Lima said it should be noted that the manager wasn’t able to provide any other information on the undercover officer and that no member of the Warwick Police Department was notified of any other officer being on scene at that time. The manager described the suspect as being a 5’5” Hispanic female with reddish hair. The manager said the woman passed all points of purchase with the total value of shoplifted merchandise being $303.81 and provided Lima with a sales receipt for the shoplifted items, which was later entered into evidence. As a result of information provided by the manager, Lima said Aracelis Acosta, 50, of 214 Messer St., Apt. 1, Providence, was arrested and transported to Warwick Police Department Headquarters for processing. Acosta was charged with misdemeanor shoplifting and released with a District Court summons.

Officer Quentin Tavares and another officer were dispatched to the Wal-Mart store at 650 Bald Hill Road at approximately 5:13 p.m. on April 15 for the report of a shoplifting. Tavares said he met with loss prevention personnel and the two involved parties were near the Garden Center of Wal-Mart. He said the male party was holding a purse in his hands, which Tavares placed on the hood of his vehicle. He asked if there was anything he should know about what was contained in the purse, but the man became very defensive and uncooperative and said he would not speak to him. After additional officers arrived on scene, Tavares said they spoke with the female party, who advised she was also not willing to speak with officers. Tavares said loss prevention advised that they observed an unknown male with glasses in his late 30s, approximately 5’6”, wearing blue jeans and a green hoodie, in the Auto Department, looking around suspiciously. The male was then observed selecting oil filters before he and the female moved to the Food Department, where they proceeded to conceal the merchandise in an unknown female’s purse. Loss prevention said the couple then went to the front of the store, where they selected a 50-cent bottle of water, which they paid for, before returning to the Food Department, where they selected flavored water and concealed that within the male’s green hoodie. The couple was then observed moving to the front of the store, where they passed all active registers and last points of purchase, making no attempt to pay for the concealed merchandise. Loss prevention then identified themselves and stopped the male outside the store. Tavares said the items were later recovered from the female’s purse, which was in possession of the male when exiting the store. In total, the recovered merchandise was valued at $51.30. Michael R. Anika, 33, of 43 Bailey Pond Road, West Greenwich, was taken into custody and transported to Warwick Police Headquarters, where he was fingerprinted, photographed and processed. He was charged with one count of misdemeanor shoplifting and later released with a Third Division District Court summons.

DUI

Officer Rose Michel observed a vehicle driving in the wrong lane of travel on East Avenue at approximately 2 a.m. on April 11. She said the vehicle was traveling eastbound in the westbound lane and that the lanes were divided by a median. Michel said she immediately activated her emergency equipment and the vehicle came to a complete stop in front of Wendy’s restaurant on East Avenue. Upon approaching the female operator, Michel said the woman immediately apologized and said she was not in the area and her GPS had misdirected her. Michel said she detected the faint odor of an alcoholic beverage emanating from the woman’s breath and observed mildly bloodshot, watery eyes. Michel said she could also see an open case of Corona beer in the rear passenger seat. The woman freely admitted to having consumed approximately five bottles of beer that evening, the last of which had been consumed 20 minutes earlier. After additional officers arrived on scene, Michel said she asked the woman to submit to a series of standardized field sobriety tests, which she said the woman agreed to, saying, “I am not drunk. I’m just not from the area.” Michel said due to the woman’s performance on the tests, in which she stepped off the imaginary line and took more steps than asked during the walk-and-turn test and couldn’t raise her leg off the ground for more than one second during the one-leg-stand test, it was determined she was unfit to operate a motor vehicle safely. Lesbia Marquez, 48, of 613 E. School St., Apt. 3, Woonsocket, was taken into custody and transported to Warwick Police Headquarters for processing. Michel said a search of her vehicle, which was towed from the scene, revealed several empty alcoholic beverages, including beer bottles and a bottle of cognac. At headquarters, Marquez was offered the opportunity to make a confidential phone call, which she refused. She also refused to submit to a chemical test. After she was allowed to make a phone call for transportation, Marquez was placed in a cellblock. Marquez was charged with DUI, first offense, BAC unknown, and issued citations for refusal to submit to a chemical test and leaving the lane of travel. She was later released with a District Court summons to a sober adult.
