GRAFFITI

On Dec. 1 at 5:58 a.m., Officer Daniel O’Connell was dispatched to Etco Inc., at 25 Bellow St., for a malicious damage report, done to a work vehicle.

Upon arrival, O’Connell met with the manager of Etco, who said an Etco work truck was parked in their parking lot, across the street from the business, on Nov. 30 around 4 p.m. in normal condition. When he returned to the box truck the next morning, he discovered the driver’s side portion of the box truck was completely damaged with black graffiti.

During the course of the investigation, O’Connell said he viewed surveillance video in an attempt to locate any suspects, but the area was dark and none could be located. He said viewing the video would not assist in the investigation. The approximate value of the damage was $1,000.

MARIJUANA

On Dec. 1 at 2:04 p.m., Officer Gregory Johnson observed a vehicle traveling in the area of 1009 Main Ave. above the normal flow of traffic and well over the posted 35 mph speed limit. Johnson said his radar unit measured the vehicle at 65 mph. He said stopped the vehicle as it turned into the Shell Station at 908 Greenwich Ave. The operator was asked for his license, registration, proof of insurance, and was identified as Michael Andrew Resende, 24, of 305 Cowesett Avenue, Apt. #711, West Warwick. Johnson said the vehicle was also registered to Resende. While speaking with Resende, Johnson said he could see, in plain view, a large stainless knife stuck between the front seat. Johnson said he told Resende and his passenger to keep their hands in view while he waited for a backup officer to arrive. Johnson said Resende admitted that it was a knife, and also said he had a hammer and razor knife on his tool belt.

Resende was told to leave the tools in the car, and when Officer Brown arrived, Resende and his passenger were frisked. Johnson said no other weapons were located. The knife was seized, along with a glass pipe with a greenish brown leafy material, which was believed to be marijuana, from the center console. In addition, Johnson said another glass pipe with burned residue was seized. He said Resende admitted that the marijuana and pipes were his. The marijuana, pipes, and knife were photographed and maintained as evidence by Johnson, until it could be field tested, which resulted in a positive test for marijuana, and forwarded to the evidence locker.

Resende was cited for speeding, with the charge reduced to +11 mph, and for possession of marijuana. He was also given a warning about possessing a weapon other than a firearm.

Johnson said his radar unit was calibrated (internally and externally prior to the stop and at the conclusion of his shift) and it was functioning properly.

DUI OR

REFUSAL

On Dec. 3 at 12:47 a.m., Officer Javier Cabreja was dispatched to the area of Cowesett Hills Apartments building #7 for the report of a gray vehicle with the engine running for over an hour. While en route to the call, dispatch advised that according to an uncooperative reporting party, an unknown subject had previously driven around the lot striking some of the vehicles.

Upon arrival, Cabreja said he saw a gray vehicle with its lights on and its engine running in front of building #7. He said the operator of the vehicle, upon noticing the officer’s arrival on scene, immediately put the vehicle in reverse and attempted to leave, so Cabreja parked directly behind it, forcing the operator to stop and put it in park. Cabreja said the gray 2001 silver Acura’s plate did not match the one given by dispatch, but it was the only vehicle in the vicinity and the description matched the vehicle in question.

Upon making contact with the operator and sole occupant, identified as Abdulaziz Almalki, 23, of 2928 Pawtucket Ave., Apt. #25, East Providence, Cabreja said he immediately detected the strong odor of an alcoholic beverage emanating from his breath and his eyes were bloodshot and watery.

Amalki told Cabreja he was facing the playground area of the complex reminiscing of a time when he and his girlfriend visited that playground. He said he misses his girlfriend very much and that was why he drove from his apartment in Riverside (East Providence) to Warwick.

When asked if he had consumed any alcoholic beverages that evening, Almalki said he had consumed one beer inside his apartment. While speaking with Amalki, Cabreja said he could see in plain view a brown paper bag in the vehicle that was soiled and appeared to have an alcoholic beverage inside it. At that moment, he asked Amalki if he would submit to a series of standardized field sobriety tests, to which he agreed.

Due to the strong odor of an alcoholic beverage emanating from Amalki’s breath, along with his performance on the field sobriety tests, all of which he failed, Cabreja deemed Amalki unfit to safely operate a motor vehicle and took him into custody.

Amalki was transported to Warwick Police headquarters, where he agreed to submit to a chemical test. The first sample read .096 and the second sample read .089. Upon completion of the test, he was printed and processed, then secured inside a cell. Amalki was charged with DUI alcohol-first offense, BAC .08-.10, with a District Court date and later released to a sober adult.
