POPPING OFF

On July 6 at about 4 a.m., members of the Warwick Police Department responded to Harvard Avenue for the report of a domestic disturbance. Prior to their arrival, it was further reported to the police that there was a “popping ” noise coming from inside the residence. Warwick officers approached the residence believing a firearm may be involved in the disturbance.

Police cautiously approached the residence and made contact with a male witness outside, who said, “[Things are] getting real inside. You’d better get in there.”

When asked to elaborate on his statement, the man said there were four people inside, and one of them, a male, had a firearm.

Officers entered the residence where they encountered two male witnesses, a female victim, who lives at the residence, and the male suspect, identified as Justin Cabral, 25, of Warwick.

Officers located a semi automatic firearm under a pillow on a couch. Through investigation it was determined that the firearm belonged to Cabral. He had been at the house with the woman. The three other males arrived, and an argument ensued between them and Cabral.

During the course of the argument, Cabral discharged his firearm into the couch as a “warning shot ” to the other males. Evidence was located to indicate that there were multiple discharges of the firearm on the property.

No one was injured during this incident.

Based on the investigation it was determined that Cabral would be charged with a felony, License Required for Carrying Pistol, and two misdemeanors: Firing in a Compacted Area, and Domestic Disorderly Conduct toward the woman.

No other charges are pending as a result of this incident.

Cabral was arraigned at Kent County Court on July 6. He was released on bail and ordered to not have contact with the woman and/or one of the male witnesses.

OFFICER STRUCK WHILE DIRECTING TRAFFIC

On Sunday July 10 at 9:08 p.m., the Warwick Police Department responded to the area of Warwick Avenue and Sandy Lane where they were conducting manual traffic control due to a power outage. While directing traffic a patrolman from the Warwick Police Department’s Traffic Division was struck by a vehicle. The officer, who was alert and conscious after the accident, was transported to Rhode Island Hospital where he was treated and later released in the early hours of July 11.

The investigation disclosed that the driver of the vehicle was traveling east on Sandy Lane and attempting to make a left hand turn onto Warwick Avenue northbound when he crossed left of center into the direction of oncoming traffic and struck the officer. The operator appeared to be under the influence and a DUI investigation was conducted. The driver of the vehicle, Thomas Horne, 64, of Church Avenue in Warwick was charged with Refusal to Submit to a Chemical Test and Driving Under the Influence (BAC Unknown).

TOOLS TAKEN

On July 1 at 4 p.m., Officer David Boardman was dispatched to 53 Hope Avenue for the report of a larceny.

Upon arrival, Boardman met with the reporting party, who said when he returned home from vacation visiting his family, he noticed his work van had been broken into. He said miscellaneous tools were stolen from his van worth an approximate total of $5,000. The man said he works on refrigerators, so a lot of tools were pertinent to that line of work, along with other miscellaneous tools.

The man said he left for vacation about a week ago and returned home on June 29. He said when he left for vacation, everything was in the vehicle but he did not check on anything when he returned. It was not until June 30 that he noticed a bunch of his tools had been stolen from his truck. The man said he may have left the door unlocked. Boardman said he did not observe any signs of forced entry.

The man said the spoke with his neighbors, but none of them saw anything or heard anything. He said nothing was taken from his home or his property. No suspects.

DUI & REFUSAL

On July 2 at 1:21 a.m., Officer Michael Walker and Officer Michael Harris were dispatched to Love Lane at Major Potter Road for the report of a motor vehicle accident in which a single car had struck a telephone pole.

On scene, Harris said he observed a green 2002 BMW 4-door resting against a telephone pole. The vehicle had heavy damage on all sides. The stonewall on the east side of Love Lane also had heavy damage. Approximately 100 yards down the road, Harris said there was a second telephone pole, which was sheered with wires hanging in the roadway. Harris said it was apparent the vehicle struck both telephone poles in addition to the stonewall. Located 50 yards from the vehicle, there were two male parties, one of which identified himself as the operator, Jason A. Garces, 28, 290 Diamond Hill Road, Warwick and the other as the passenger.

At this time, Warwick Fire & Rescue personnel were on scene and both parties were offered medical aid, which the passenger accepted after he said he was feeling faint from hitting his head. Rescue assisted him and then transported him to Rhode Island Hospital for evaluation. Garces refused all medical aid on scene.

When asked where he was coming from, Garces said McKinley’s Pub in East Greenwich. He said he was on his way home. While speaking to Garces, Harris said he had mumbled, slurred speech, his face was blotchy red, his eyes were severely watery and bloodshot, and an odor of an alcoholic beverage could be detected on his breath. Garces admitted to having three beers at McKinley’s. Despite all evidence on scene indicating Garces was traveling northbound on Love Lane, he was adamant he was traveling toward East Greenwich in a southerly direction.

Garces agreed to submit to a series of standardized field sobriety tests, which he failed. He also refused to submit to a preliminary breath test on scene. Based on the investigation, Garces was deemed unfit to operate a motor vehicle safely due to intoxicating effects of liquor and/or drugs and was taken into custody and transported to Warwick Police headquarters without incident.

At headquarters, Garces refused to submit to a chemical test. While being processed, he requested medical aid and said he was feeling faint. Warwick Fire & Rescue was requested to the cell block and Garces was transported to Kent Hospital for medical aid.

Garces was issued three violations for the following: DUI/Drugs/Alcohol/First Offense – B.A.C. Unknown, with a mandatory Third District Court date; Refusal to Submit to Chemical Test (First Offense); Refusal to Submit to Preliminary Breath Test; Laned Roadway Violations, with a mandatory Rhode Island Traffic Tribunal court date; and Leaving Lane of Travel, also with a mandatory RITT court date. Garces was held for a special bail hearing, as he is currently on probation for an unrelated charge.
