DUI AND REFUSAL

Officer Nicholas Reay reported stopping a car speeding erratically on to Route 2 around 1 a.m. on Feb. 3. He said he followed the car as it made lane changes without signals until he pulled it over on Ginsu Way. He said the driver appeared to be intoxicated and smelled of alcohol and admitted he had at least two Long Island Iced Teas at a bar in Providence. He said the driver failed the field sobriety test and was taken to headquarters where he blew a .142 and .138 blood alcohol content on the breath test. Charles F. Moreau, 42, of 565 Quaker Lane in West Warwick was charged with DUI and later released with a summons.

Officer Christian Vargas reported he was dispatched to an accident near Jefferson Boulevard and the Airport Connector around 10 p.m. on Feb. 1. He said it appeared a pickup truck was attempting to turn left onto the connector when the other vehicle struck it. He said the driver of the car appeared to be intoxicated but did not smell of alcohol and denied she had taken any medication. He said she eventually admitted she took medication but only in the prescribed dose. Reay said he did find a leafy substance that looked like marijuana but did not smell like it and that it was in a plastic wrapper with a picture of “The Joker” from Batman on it. He said the driver failed a field sobriety test and he informed her she was under arrest for driving under the influence of something and was transported to Rhode Island Hospital for a blood test. He said he informed her that he wanted her to take a chemical test but she became emotional and claimed she didn’t understand him. She said she did not want to take a test but she was not using drugs. Reay said he reminded her that the test was to determine if that was true and get the charges dismissed. He said she told him she did not want a test but she was not refusing to take one. Reay said he told her that would be taken as a refusal and she was charged with DUI and refusal, with the substance to be determined after the leafy stuff in the “Joker” bag was analyzed. Stephanie L. Dion, 25, of 58 Marshall Circle in Coventry was issued a summons and left in the care of the medical staff.

Officer Charles Austin reported he was on patrol around 2 a.m. on Feb. 2 when he clocked a car doing 56 miles per hour on Bald Hill Road. He said he followed the car and saw it cross the double yellow lines twice on Toll Gate Road and pulled it over for being in the wrong turning lane at Providence St. He said the driver appeared to be drunk and smelled of alcohol. He said he asked the man out of the car for a field sobriety test and noticed how much he swayed as he tried to stand. He said the driver began to get belligerent as they progressed through the field test and he refused to do the one leg stand. He said Kevin J. Sokolowski, 22, of 75 Brayton Ave. in Warwick, refused a breath test at headquarters and told Austin he was “not going to sign a [expletive] thing.” He was charged with DUI, refusal and laned roadway violations and later turned over to a sober adult.

Officer Austin said he was on patrol around 5:35 a.m. on Feb. 3 when he went to an accident at New England Tech on Post Road. He said there was a black Volkswagen well into a fence after hitting a telephone pole. He said the man driving told him he fell asleep but he was not injured in the crash. Austin said he called Warwick Rescue anyway because the driver smelled of alcohol and admitted he’d had his last drink around 2 a.m. He said the driver refused the treatment from Rescue and refused to go to Kent Hospital. He said he could take a field sobriety test, but he failed to pass it and was arrested and taken to headquarters where he blew a .197 and a .190 blood alcohol content on the breath test. Jason D. Trigueiro, 25, of 164 Wilson Ave. in Warwick was charged with DUI and cited for leaving his lane of travel. He was then transported to Kent Hospital for detox.

Officer John Larivee reported clocking a car doing 52 miles per hour on West Shore Road. He said he turned and followed the car at an estimated 60 miles per hour as it straddled the travel lanes and entered the breakdown lanes several times before stopping near 2975 West Shore Rd. He said he approached the driver and saw he was slumped behind the wheel and seemed drunk and smelled of alcohol. He said the driver agreed to take a sobriety field test but couldn’t get past the first few instructions and he was taken to headquarters where he registered a .202 and a .206 blood alcohol content. He was charged with DUI and possession of marijuana. Robert A. Perras, 51, of 29 Clubhouse Rd. in Coventry avoided possession of prescription painkillers when his wife produced a valid prescription for it. He was later released to his wife.

Officer John Curley said he pulled a car over for running a red light on Main Avenue around 2:10 a.m. on Feb. 4 and ended up charging the driver with DUI and refusal. He said he pulled the car over near Benny’s on West Shore Road and noticed a strong smell of alcohol coming from the driver, who appeared to be drunk. He said the driver refused to finish the field sobriety test because he had a pain in his left ear. Kevin M. McEvoy, 54, of 63 Haswill St. in Warwick was taken to headquarters where he refused a breath test. He was charged with DUI and refusal, second offense, and taken to Kent Hospital for detox.

Officer Rose Michel reported an accident on Ives Road around 4 a.m. on Feb. 2. She said Warwick Rescue was with the driver who just got out of a rolled over Dodge Avenger. Michel said it looked like he hit a tree on the side of the road before it rolled. She said the driver appeared to be not seriously injured, but he did smell of alcohol and became belligerent with Rescue and Police. He refused to take a field sobriety test and continued to be rude to rescue workers who insisted he be taken to the hospital. She said the driver refused a blood test at the hospital and was charged with DUI, refusal, failure to maintain control of his vehicle and not wearing a seat belt. Jamie W. Bataycan, 20, of 38 Peaceful Lane in North Kingstown was later released to a sober adult.

    Don't you love the DUI laws in RI, Kevin M. McEvoy has had 2 prior DUI's, one in 1988 and one in 2009 along with possession charges and they don't count the 1988 because it is more than 5 years old. This is why we need to toughen our laws.
