DUI OR REFUSAL

Officer Keri-Ann Leighton reported stopping a van on Post Road for driving erratically on Jan. 11. She said she immediately smelled alcohol as she spoke with the driver. She also said she asked her where she was going and the driver said to a friend’s house and, when asked where she was coming from, named the same friend. Leighton said she denied drinking but admitted smoking marijuana. She said the driver, identified as Kristin Jones, 19, of 47 Auburn St., Cranston, was given a field sobriety test and she failed it. He said she was taken to headquarters, where she refused to take a breath test. She was charged with DUI, refusal, possession of marijuana, possession and transportation of alcohol by a minor and laned roadway violations.

Officer Thomas Duncan reported he was dispatched to Taco Bell on Bald Hill Road around 1:35 a.m. on Jan. 10. Dispatch said a customer punched the drive thru window and was causing a disturbance. He said he pulled the suspect car off to the side and spoke with the driver. He said the driver fumbled around or stared blankly as he was speaking with him and he asked him out of the car for a field sobriety test. He said he smelled strongly of alcohol and appeared to be drunk. He said the driver failed a field sobriety test and was taken to headquarters, where Jonathan E. Termeer, 27, of 15 Sandro Circle, Warwick, was charged with DUI and refusal. Duncan said the cashier told police she called them because the passenger got out of the car in the drive thru lane and approached the window. She said it is the company’s safety and security policy to close and lock the drive-thru when a passenger or driver gets out of a vehicle. She said she told the passenger to get back in the car, but he punched the window instead. There was no damage and the passenger was not charged.

Officer Nicholas Reay reported an accident near the Target store at 1245 Bald Hill Rd. around 4:30 p.m. on Jan. 4. He said the driver of a Toyota RAV 4 was slumped over the steering wheel and witnesses were saying she seemed drunk. He said the rear end of the vehicle was smashed and he saw about 15 empty wine and vodka bottles in the passenger area. Reay said he asked the woman to take a field sobriety test in the parking lot and said he had to have her sit for the nystagmus test because she was so unsteady on her feet. He said he decided that he would not complete the test because she could not stand on her own and do the test safely. Maria Louisa Tavares, 56, of 450 Providence St., West Warwick, was taken to Kent Hospital, where she refused to take a chemical test. She was charged with refusal and DUI, second offense. She was later released to the care and custody of the hospital staff for detox.

Officer Daniel DiMaio reported he was on patrol around 2:30 a.m. on Jan. 1 when he saw a car pull onto Post Road without stopping first and then stopped in the right lane, blocking it off and causing a van to swerve to the left to avoid hitting it before it pulled onto Route 95, where DiMaio was attempting to pull it over when it entered the left lane and almost hit another vehicle before it eventually pulled off the road. He said the woman who was driving said she had just left a party but didn’t have anything to drink. He said she looked drunk and smelled strongly of alcohol. He said he got her out of the vehicle for a field sobriety test and she failed it. Melissa E. Roberts, 19, of 15 Luna St., Providence, was taken to headquarters, where she refused to take a breath test. She was charged with refusal, DUI and laned roadway violations and later released to a sober adult.

Officer Adam Arico reported he was on patrol around 1:30 a.m. on Dec. 28 when he clocked a car doing 60 miles per hour on Bald Hill Road. He said he also saw it cross the double yellow lines and drift across the road for about three-quarters of a mile before it pulled over and struck the curb. He said the driver fumbled all the time he was getting his license and registration and looked and smelled drunk. He said he ordered him out of the car for a field sobriety test and noticed he was unsteady on his feet and went on to fail the test. Scott Gobin, 27, of 11 Angell St., West Warwick was taken to headquarters, where he registered a .150 and a .148 blood alcohol content n the breath test. He was charged with DUI, speeding and laned roadway violations and later released to a sober adult.

Officer Matthew Moretti reported an accident between a car and a utility pole near Main Avenue and Post Road around 4:45 p.m. on Dec. 31. The driver was standing next to her vehicle and she appeared to be under the influence and was swaying back and forth. He said she admitted she had two margaritas. He said he asked her if there was anyone else in the vehicle with her and she told them there was and that “somebody grabbed the steering wheel and forced her into a telephone pole.” He said she didn’t know who that was but whoever it was “they left.” He said all the other officers who arrived at the scene from different angles reported seeing no one on foot. He said he gave the driver a field sobriety test and she said, “Now I have to walk sideways nine steps, correct?” He said he told her to do what he asked her to do and she said he asked her to walk sideways. He said she failed the test and was taken to headquarters, where she refused to take a breath test. Michelle C. Salgueiro, 21, of 66 Cleveland St., West Warwick, was charged with DUI and refusal and later released to a sober adult.

Officer Robert Gauvin reported getting a call about a drunk trying to drive out of the parking lot at 444 Quaker Lane around 5:55 a.m. on Jan. 1. He said he arrived to find the driver moving around in the parking lot of Denny’s, apparently lost, but by the time he got there the car was heading north on Quaker Lane, through a solid red light and made a left on Cowesett without a signal and was pulled over. He said the driver had to hold onto his door when he got out for a field sobriety test and suddenly became verbally abusive and called Gauvin a “stupid [expletive] cop” that was on a “power trip.” He said the driver called him a liar when the told him he didn’t have a portable breath tester. He said he eventually put handcuffs on the driver when it appeared he was posturing for a fight. He said the driver claimed he had an IED (improvised explosive device) in his pocket when they got to headquarters, but they didn’t find one. He said the driver registered a .170 and a .173 blood alcohol content on the breath test. James E. Barchi, 31, of 200 William Henry Rd., North Scituate, was charged with DUI and running a red light and was later turned over to a sober adult.

Officer Quentin Tavares reported an accident near Workout World on West Shore Road around 7 p.m. on Dec. 28. He said both drivers were out of their cars when he arrived and both said they didn’t need medical attention. He said one of them rear-ended the other and was very apologetic and also smelled of alcohol and appeared to be intoxicated. He said he gave the driver a field sobriety test and he failed it. He said the driver was taken to headquarters without incident and he refused to take a breath test. Brian Albert Shovelton, 42, of 187 Northup St., Warwick, was charged with DUI and refusal and later released to a sober adult.

Officer Robert Gauvin was on patrol around 2:50 a.m. on Dec. 28 when he was dispatched to an accident on Shenandoah Road. He said a Ford pickup was parked at an angle in the driveway of 12 Shenandoah with significant damage to the left rear and gouge marks on the grass beside the driveway and a nearby fence, caused by being pushed when a black Mercedes Benz slammed into it. He said the Benz was parked on the street and had significant damage to the front left quarter. He said the driver of the Benz was intoxicated and told Gauvin he turned onto Shenandoah from Post Road and blacked out and crashed into the pickup truck. The owner of the pickup said he heard a loud bang outside earlier, followed by the Benz driver knocking on the door to tell him he hit the truck. He said the Benz driver, identified as Phillip L. Tillett, 44, of 196 Cumberland Rd., Warwick, was failing a field sobriety test when he refused to complete it. He also refused to take a breath test at headquarters. He was charged with DUI, refusal and failure to maintain control of his vehicle.
