DUI AND REFUSALS

Officer Manuel Pacheco reported he was dispatched to an accident near 1501 West Shore Rd. on Dec. 21. He said he approached one of the drivers who was beside a Ford pickup truck who staggered and held onto the tailgate for balance. He said the man told him he did not need medical attention and said he was driving along West Shore Road when he wanted to take a left onto Draper Avenue but misjudged the distance of a car coming from the other direction and hit the car. Pacheco said the driver smelled of alcohol and appeared to be under the influence. He said the driver refused to take a filed sobriety test and was taken to headquarters where he refused to take a breath test. Pacheco said other officers reported finding beers in a cooler in the back seat and a six-pack of Blue Moon beer. William J. Smith, 54, of 184 Riverside Ave. in Warwick was charged with failure to yield the right of way, DUI and refusal. He was later released to a sober adult.

Officer Kevin McGuire reported a suspected drunk driver near the Greenwood Credit Union around 9:30 p.m. on Dec. 21. He said he found another officer had stopped the car on Burt Street and he asked him for his papers and checked on him as McGuire questioned him about where he was going and coming from. He said the driver smelled of alcohol and appeared to be drunk even though he said he had a couple of beers “a few hours ago.” He said he gave the driver a field sobriety test that he failed and the driver was arrested and taken to headquarters when he refused a preliminary breath test and refused to take a breath test at headquarters. Derek Paquette, 26, of 18 Myrtle Ave. in Warwick was charged with running a stop sign, not using a turn signal, DUI and refusal.

Officer Nicholas Reay reported he was dispatched to an accident at Samuel Gorton and Armstrong Avenues around 5:15 p.m. on Dec. 22. The driver of a pickup truck told Reay he was traveling west on Samuel Gorton when the other driver pulled in front of him and he did not have enough time to stop before they collided. He said the other driver smelled of alcohol and appeared to be drunk. Reay said there was an empty vodka bottle on the back seat of the car. Reay said the driver exhibited four out of four clues to intoxication on the first field sobriety test and he canceled the rest of the test for fear of the driver falling and injuring himself. He said the driver told him he was diabetic but was not insulin dependent and Warwick Rescue arrived to prick his finger and measure his blood sugar. They said the level was perfect. The driver was asked to take a preliminary breath test and he refused. He was taken to headquarters where he refused a breath test. Mark F. Rowland, 52, of 40 Francis St. in Cranston was charged with DUI, refusal, not using a turn signal and no evidence of insurance. He was later transported to Kent Hospital for detox.

Officer Rose Michel reported an accident on Commonwealth Avenue. She said she arrived to find the driver of the car was missing and was told he walked away from the scene, presumably to his girlfriend’s house nearby. She said the driver denied drinking alcohol that day but admitted he had marijuana. A witness told police she believed he had taken pills and alcohol earlier. She said a field sobriety test revealed he was not in a condition to operate a vehicle. Joshua Gellman, 24, of 434 Newcomb Rd. in North Kingstown, was taken to headquarters where he registered a .000 blood alcohol content. He was taken to Kent Hospital where he refused to submit to a blood test for narcotics. He was charged with DUI and refusal and taken back to headquarters to await arraignment.

Officer John Curley reported an accident with injuries on Church Avenue around 7:40 p.m. on Dec. 17. He said he found a car that had gone through a fence at 391 Church Ave. and was now in the backyard where Warwick Rescue was attempting to extract the male driver from a 2005 Nissan Altima. They got the driver out and put him on a backboard for transport to Rhode Island Hospital. He said he followed them and spoke with the driver there. He said the driver admitted he had “a couple.” Curley said his training and experience indicated that the driver was under the influence but the driver refused to take a chemical test. Evan D. Ferreira, 32, of 215 Reynolds Ave. in Warwick was charged with DUI and refusal and left in the care of the hospital.

Officer John Zaborski reported a rear end accident at West Shore Road and Oakland Beach Avenue around 6:50 p.m. on Dec. 15. The suspect vehicle was said to have pushed the car in front of it into the car in front of that, involving three cars. The driver who hit the cars said she didn’t see any vehicles before she hit the one in front of her. He said she admitted she had a glass of wine after he noticed a strong smell of alcohol. He said she failed a field sobriety test and didn’t realize she had already passed her street when he asked her where she was going and said, “I just want to go home.” She was taken to headquarters where she refused to take a breath test. Laura E. O’Donnell, 45, of 31 Allard St. in Warwick was charged with DUI and refusal and later released to a sober adult.

Officer Sokphannareth Chea reported being dispatched to an accident at Imperial Drive and Main Avenue around 7 p.m. on Dec. 19. He said the caller claimed she had almost been hit before the suspect hit a No Parking sign. Chea said the driver failed a field sobriety test and registered a .236 blood alcohol content on the portable breath tester. John N. Fortin, 49, of 879 Main Ave. in Warwick was taken to headquarters where he refused another breath test. He was charged with DUI, refusal and driving without proof of insurance. He was taken to Kent Hospital for detox when no one could be found to take him home.

Officer John Curley reported he was dispatched to the Wal-Mart on Post Road around 10:05 p.m. on Dec. 19 for an accident at the end of the parking lot, where a car hit a guardrail. He said he found the car pressed against a light pole. He said he asked the driver if she was all right but she denied she had been in an accident and said she was fine. He said she smelled of alcohol and appeared to be drunk and when he questioned her she said, “Yeah, I’m drunk, so what?” Curley said she appeared so drunk he decided it would be dangerous to attempt a field test. He said they found a trazodone and oxycodone in the car so she was taken to Kent Hospital for a blood test but she refused it. He left Jana M. Houser, 46, of 26 Hasbrouck Ave. in Warwick for detox and charged her with DUI and refusal and then got a statement from a witness to the accident.

Officer Nicholas Reay reported an accident at the intersection of Airport Road and Post Road around 10:20 p.m. on Dec. 20. He said one of the drivers involved was being held up by another person who let go of him as Reay approached. He said the driver immediately began to fall and had to be grabbed again. He asked the man where he was and he had no idea. He said the man candidly told him, “I just have to be honest … I’m extremely drunk.” He said he stopped all further testing when the driver said, “I’m drunk, I’m drunk. I’m drunk!” Nicholas W. Lonardo, 33, of 93 Jennie Lane in Warwick was transported to Kent Hospital for evaluation and refused to take a blood test. He was released to the hospital staff.

BLOWING SMOKE

A resident of 4th Avenue in Warwick called police to say that he and his wife discovered that her car had been rifled through overnight on Dec. 19. He said there were wrapped gifts in the car intended for clients of her business and someone opened every one of them and the only thing that was missing was a pack of cigarettes. No suspects or witnesses.

MORE SMOKE?

Officer Stephen Major reported that a 19-year-old Cranston woman came in to headquarters on Dec. 26 to report that her wallet went missing between 7 p.m. and 7:30 p.m. on Dec. 20, while she was working her shift at Walgreens. She said the wallet contained her driver’s license, a debit card, which already had $120 charged to it, and that the wallet was worth $20 but it contained a diamond ring worth $10,000. She told Major she was unaware that she could have called police to report it at that time and waited until after the holiday to report it. He said he put her written statement into records.
