MISCELLANEOUS PROVISIONS AND OFFENSES
ARTICLE I
IN GENERAL
Be it ordained by the City of Warwick:
Section I. Chapter 40 Article I of the Code of Ordinances of the City of Warwick is hereby amended as follows:
Sec. 40-30. - Smoking prohibited in public schools and on school grounds.
It shall be unlawful for any person to smoke or use any tobacco products or any electronic nicotine delivery system in any public school building or upon school property. No person under the age of 18 years may possess tobacco in any form or an electronic nicotine delivery system while in any public school building or upon school property. Violation of this section shall be punishable pursuant to section 1-4 of the Code of Ordinances under the jurisdiction of the municipal court. Violation of this section shall be punishable by a fine of $100.00 for the first and second offense by a person. The fine may be paid by mail or in person at the city municipal court.Upon the third and each subsequent violation of this section, a person shall be subject to the penalties set forth in section 1-4 of the Code.
All violations of this section alleged to have been committed by any person under the age of eighteen years shall be referred to the juvenile hearing board. First offenders shall be required to successfully complete a tobacco abuse counseling program, the cost of which shall be borne by the offender. Any subsequent offense or failure to successfully complete the tobacco abuse counseling program imposed for a first offense shall be punishable by a fine of not less than $100.00, or 20 hours of community service.
Section II. This Ordinance shall take effect upon passage and publication as prescribed by law.
