DUI

Just before 7 p.m. on Jan. 3, Officer Michael C. Bailey was on patrol in the area of Warwick Avenue and Squantum Drive when he was notified of a motor vehicle offense in progress.

Bailey traveled north on Warwick Avenue and observed the suspect vehicle, described as a red Toyota Corolla, heading south. The vehicle is said to have crossed the double-yellow line into the oncoming lane of travel, nearly striking the officer’s cruiser.

Bailey turned to pursue the vehicle and attempted to initiate a motor vehicle stop. The vehicle initially failed to stop as it traveled onto Squantum Drive, but then complied.

Bailey made contact with the operator, who is said to have initially provided a false name. The officer reports detecting a strong odor of alcohol inside the vehicle and on the breath of the operator, who additionally exhibited “bloodshot, watery eyes.” The officer also observed two empty pint-size tequila bottles and an open beer container inside the vehicle.

Bailey reports he attempted to administer field sobriety testing on the operator but was unable to complete the tests due to safety concerns, a language barrier and the man’s difficulty in following instructions. Another officer then arrived on scene and indicated the operator had allegedly been involved in a motor vehicle accident prior to the stop.

Manuel Pablo, 35, 104 Waverly St., Apt. 1, Providence, was arrested for suspicion of driving under the influence and transported to Warwick Police headquarters for processing. While at headquarters, he is said to have agreed to a chemical breath test, which reportedly found his blood alcohol level to be significantly above the legal limit.

Pablo’s true identity was determined through a fingerprint database check, according to Bailey. That led to the discovery that Pablo was wanted on an active bench warrant issued from Third Division District Court.

Pablo was held on the warrant and as a probation violator. He was later transported to the Adult Correctional Institutions.

He was charged with driving under the influence, operating without a license and obstructing an officer in the execution of duty.

At the scene, the reporting party told Michel that her 2014 Jeep Cherokee had been left unlocked in the home’s driveway the previous day. On the morning in question, she returned to the vehicle and discovered the center console had been rummaged through and the backpack was missing.

The backpack was said to have contained a number of items of value, including a leather wallet, $70 in cash, a driver’s license, dental and health insurance cards, department store membership cards, several debit and credit cards and a $100 gift card. According to Michel’s report, the gift card and several of the membership cards were subsequently found in the roadway nearby.

The reporting party told Myer that he had lost his wallet while shopping in Warwick on Jan. 6, although he was unsure of the store at which it went missing. He said the last place he used the wallet was a convenience store, possibly the 7-Eleven at the West Shore Road and Oakland Beach Avenue intersection.

The reporting party said he was notified Jan. 8 that his credit card had been used to make a fraudulent purchase in Cranston. The wallet is said to have contained nearly $300 in cash, two credit cards, two debit cards, a passport, a Massachusetts driver’s license, health insurance cards and lottery tickets.

Clarence E. Nealy, 26, 224 Park Ave., Apt. 2, Cranston, was arrested on a charge of driving with a suspended license, third or subsequent offense, and transported to Warwick Police headquarters for processing.
