DUI, refusal to test, vandalism/malicious damage

On April 16, at about 4:39 p.m., Officer Araujo and a fellow officer were dispatched to the area of Warwick Ave., and Church Ave., for the report of an erratic driver.

It was reported that the driver had struck another vehicle, hit various curbs and went through a red light at an intersection.

A witness said they observed multiple traffic violations as well as an accident with the suspect. The witness advised that she was at the intersection of Fair Street and Narragansett Parkway and saw the vehicle “roll into a Lexus SUV.” The witness advised the driver did not stop.

The driver went on to strike an unoccupied vehicle. The witness said the driver went through two red lights and drove over the yellow lines into oncoming traffic.

Officer Araujo initiated a motor vehicle stop. Upon his arrival, he could detect a strong odor of alcoholic beverages emanating from the driver’s mouth as he spoke with mumbled speech. Officer Araujo observed the operator to have moderately bloodshot and watery eyes. Officer Araujo also observed a Fireball Whiskey that was a quarter full on the driver’s side floor, after asking the operator to step out of the vehicle.

When asked if he consumed any of the whiskey, the operator said, “a little.” Officer Araujo then asked the driver to consent to a field sobriety test, to which he consented.

After the test was complete, it was in Officer Araujo’s opinion that the operator was under the influence of intoxicating liquor and/or drugs. The operator was arrested and while at the department, it was later determined that the suspect intentionally urinated on the floor of his cell prior to being processed.

The driver was charged with DUI BAC Unknown, Refusal to Submit to a Chemical Test 2nd Offense and Vandalism/Malicious Damage to Property.

DUI

On April 18 at about 8:27 p.m., Officer Davis was on patrol and saw a driver commit laned roadway violations.

Davis conducted a motor vehicle stop and was immediately met by the overwhelming odor of freshly burnt marijuana. The operator stated that he was headed to the marijuana dispensary. When asked if he had consumed any alcohol or smoked any marijuana prior to the stop, he admitted to smoking marijuana earlier.

Throughout the interaction, Davis observed the operator’s eyes were bloodshot and glassy. Officer Estrella and Sgt. Larson shortly showed up after to assist.

Davis instructed the operator to exit the vehicle. When he exited, Davis noticed his belt to be unbuckled and his pants to be unbuttoned. When asked the reasoning, the operator expressed confusion as to when that occurred.

Away from the odor of freshly burnt marijuana, Davis was able to detect the odor of an alcoholic beverage from the driver’s breath. Suspecting the driver is under the influence of alcoholic beverages and/or drugs, Davis asked the driver to submit to a series of sobriety tests, to which the operator refused initially but eventually agreed to.

The suspect stated that he was "just high" and that Officer Davis could give him "a ticket for being high," he advised. Following the tests, Officer Davis concluded that evidence proved the operator was under the influence.

The operator admitted to having two beers before smoking and prior to departing the scene, Officer Estrella found approximately eight empty shot containers and an unopened shot located in the cup holder.

Several empty containers of dispensary marijuana cigarettes, along with several fully burnt marijuana cigarettes, were also found within arm’s reach of the driver's seat.

The operator was charged with DUI of Liquor- Blood Alcohol Unknown, and was awaiting a bail commissioner. 

TRESPASS

On April 19 at about 4:32 p.m., Officer McHugh and Officer Walker were dispatched to the Pizza Hut at 1627 Warwick Ave. Upon arrival, Officer McHugh observed a female screaming, swearing, video recording and acting belligerent and threatening. She appeared to be highly intoxicated.

Officer McHugh observed an odor of alcohol emanating from her breath as well as slurred speech. Two witnesses said the female suspect had assaulted them both and they wished to pursue criminal charges.

Officer Walker retrieved voluntary statements. The following information was derived. Witness #1 indicated that the female suspect arrived at the store yelling and swearing. Witness #1 asked the suspect to back up and the suspect was not compliant and threw a punch at Witness #1, striking her in the side of the head.

The Witness #2 provided a statement from which the following information was derived. Witness #2 advised that the suspect came into the store yelling, looking for “Ashley,” saying that she was going to drag her around. Witness #2 asked the suspect to step back. Witness #2 stated that the suspect then swung at the Witness #1, striking her in the head, and poked Witness #2 in the eye with her finger.

The suspect was advised of the trespass. Due to the witnesses wishing to pursue criminal charges, the suspect was handcuffed by Officer McHugh and was later released from police custody.
