MALICIOUS DAMAGE

On Feb. 18 at 2:25 p.m., Officer Mark Jandreau was dispatched to West Shore Road for the report of a malicious damage.

Upon arrival, Jandreau met with the reporting party, who said the building located at 1175 West Shore Road had two windows with what she believed to be bullet holes, which had been reported to her after being discovered by tenants of the building on Feb. 13. As the overseer of the building, she is reporting the damage, specifically involving two windows with three or more holes in the vinyl siding on the second floor (right side) of the building.

Jandreau looked at the damage. He said they were not bullet holes but appeared to be three either BB or pellet holes in the vinyl siding, and two of the upper windows had a small hole in each of them. Jandreau subsequently completed an offense report number to document the damage and issued that report number to the overseer of the building in order for her to contact her insurance company. No suspects.

On Feb. 21, Officer Brian Murray was dispatched to the Holiday Inn Express located at 901 Jefferson Boulevard for the report of malicious damage to a vehicle.

Upon arrival, Murray met with the reporting party, who said that morning around 8 she and her daughter noticed one of the windshield wipers to their rental vehicle had been damaged.

They said when they parked the vehicle the day before; another guest had been behind them and may have gotten upset since they took the last parking spot. Once they exited the vehicle and entered the hotel, they said that an occupant of this other vehicle stared at the woman’s daughter. Murray said neither the woman nor her daughter saw the suspect damage the vehicle. The woman pointed out the other vehicle, which was still in the lot.

On Feb. 22 at 3:28 p.m., Officer Eric Lima was dispatched to the parking lot at St. James Place, 200 Bald Hill Road, for the report of malicious damage to a blue BMW, specifically a tire having been slashed.

Upon arrival, Lima met with the reporting party, who said that he parked his vehicle, a blue 2002 BMW 330I, four-door sedan, in between Pro Fitness and Second to the Sun Tanning at approximately 10 a.m. on Feb. 22. He said his vehicle was not damaged and he had not struck any potholes on his way to work. He said at 1:30 p.m. he walked to his vehicle for his break and noticed that his rear passenger tire was flat. As he approached the vehicle, he observed a slash in the tire and contacted Warwick Police. The man said he wished to have the incident documented and that he did not have any suspects at that time.

Upon observing the flat rear passenger tire, Lima said he noticed what appeared to be a cut in the sidewall, approximately 2 to 3 inches in length. Lima said he was unable to determine whether or not the cut in the sidewall had been the result of an intentional slashing or if it occurred as the result of impact from driving in the roadway causing a sidewall blowout.

A check of the area surveillance cameras yielded negative results.

SHOPLIFTING

On Feb. 20 at 4:55 p.m., Officer Quentin Tavares was dispatched to the Stop & Shop at 300 Quaker Lane for the report of a shoplifting. Prior to arrival, dispatch advised that the shoplifting had occurred earlier that morning, no one was in custody and they had video of the shoplifting.

Upon arrival, Tavares spoke with the reporting party, who said he was notified earlier that morning a male subject entered the store and proceeded to take several bags of shrimp and halibut, then left the Seafood Department with the eight bags in total and went toward the Pharmacy exit where he passed all points of purchase without paying for the concealed merchandise. The reporting party said the white male then got into a white Nissan Rogue, however they were unable to get a plate.

The reporting party said he was able to review the video surveillance and able to get a photograph and video of the vehicle, but there was no suspect data.

DUI

On Feb. 20 at 8:53 p.m., Officer Kevin McGuire and Officer Zaborski were dispatched to the area of Palm Boulevard for the report of a suspicious drunk male outside someone’s house. Dispatch advised the reporting party observed a male pull up outside his residence and got out of his vehicle. He said he did not know the male and that the male was drinking a bottle of beer. He said the male then got back in his vehicle, described as a beige 2000 Nissan Maxima 4-door, and left, pulling out onto Post Road after striking a parked vehicle. While en route, McGuire said he saw a Nissan Maxima traveling southbound on Post Road, in the outside lane. It was slowing and then stopped in the lane of travel.

McGuire said he turned around and pulled behind the vehicle, where he observed the operator get out of his vehicle while still in the roadway and begin looking at the driver’s side tires. At that time, Zaborski responded to meet with the witness. Officer Wells also arrived on scene to assist McGuire.

McGuire spoke with the operator, who was later identified as Jonathon Sosa, 25, of 89 King Phillip Street, Providence. When asked where he was coming from, Sosa looked at McGuire confused and shrugged his shoulders. As Sosa walked, McGuire said he was very unsteady on his feet, and he was stumbling and swaying back and forth as he stood talking to McGuire. McGuire said Sosa’s eyes were bloodshot and glossy, and as he spoke, McGuire could detect the odor of an intoxicating alcoholic beverage emanating from his breath. When again asked where he was coming from, Sosa said he was going to get his girlfriend and when asked where she lived, he said “Potters.” When asked where that was, Sosa again looked confused and attempted to walk back out into the roadway and point at his car. McGuire asked Sosa what was wrong with his car and asked if he had been in an accident, to which he said he didn’t know. McGuire said he observed damage to the passenger side of Sosa’s vehicle with white paint transfer. Officer Zaborski advised via radio that was consistent to the damage to the reporting party’s vehicle. McGuire asked Sosa if he had anything to drink that evening and he said he had “a few beers.” Sosa then agreed to submit to a series of standardized field sobriety tests.

McGuire said ended the test for fear of Sosa’s safety due to his very confused and unsteady state. Based on his observations at the scene and his training, McGuire concluded Sosa was under the influence of an intoxicating liquor and/or drugs and was unfit to safely operate a motor vehicle.

During an inventory search of Sosa’s vehicle, an open bottle of Blue Moon beer was found in the driver’s cup holder, which had several sips taken out of it. The bottle was seized and was tested at headquarters, which tested positive for alcohol.

Sosa was taken into custody and transported to Warwick Police Department headquarters, where he agreed to take the breathalyzer test and registered a 0.339 B.A.C. and a 0.341 B.A.C.

During the observation period, prior to the breath test, McGuire said he again questioned Sosa about where he was coming from. Sosa said he was drinking with his girlfriend and her family. When asked how much he had to drink, Sosa said, “To be honest with you, I probably had about like five beers, but they were strong beers like maybe 7 percent alcohol.” Sosa also stated that he was “lit” on several occasions.

Following the breath test, Sosa was turned over to the jailer for printing and processing. He was released with a Third Division District Court summons for one count of DUI of Liquor or Drugs-1st Offense .15/Greater. He was also issued a citation for Places Where Parking/Stopping Prohibited and several other violations, including Leaving Scene of an Accident and No Evidence of Insurance, as none was found in the car at the time of the stop. Due to Sosa’s extremely high B.A.C. level, he was then transported to Kent Hospital for detox.
